Legal Framework of Family Law in Pakistan:
In Pakistan, the Muslim Family Law Ordinance (MFLO) 1961 along with the Dissolution of Muslim Marriages Act, 1939 governs substantive law for family law cases, including marriage, dower, divorce, maintenance, child custody and visitation rights, and inheritance. Family Courts have exclusive jurisdiction of hearing family law cases, with appeals lying to a High Court only.
Rigid and needlessly idealistic legal advice in family law cases can instead prove counter-productive and lead to longlasting bitterness between disputing family members, rather than both parties parting ways and settling their dispute amicably. Therefore, a stage should ideally not be reached where alternative dispute resolution means are ruled out of the equation. Arbitration, as mandated by the Arbitration Council, is a crucial prerequisite under the Muslim Family Laws Ordinance (MFLO) of 1961.
